Abstract

Criminal aggravation in corruption cases committed by state officials is an important concern in the criminal justice system. This article analyzes the Judges' considerations underlying the additional punishment for corruption perpetrators who come from among state administrators. Through a normative juridical approach and legal interpretation, this research explores the substance of the law, principles, theories, and legal arguments by conducting grammatical interpretation and systematic interpretation of the analyzed decisions. This research aims to find out the Judge's consideration in applying criminal aggravation in cases of corruption by state officials. The results obtained, in practice the criminal aggravation against perpetrators of corruption who have the position of state administrators is still lacking. Many judges lighten the punishment instead of aggravating the punishment. In the midst of efforts to combat rampant corruption, it is important for the justice system to ensure that criminal aggravation is an appropriate and effective measure to provide a deterrent effect and maintain the integrity of state officials.
