Abstract

Prostitusi merupakan fenomena yang sudah ada sejak lama di dunia, tidak terkecuali di Indramayu. Bahkan prostitusi sudah merambah ke dunia bisnis hotel, Perkembangan dunia usaha (bisnis) yang menjadikan tempat-tempat peristirahatan (Hotel) dijadikan sebagai tempat prostitusi jadi hotel yang mengusahakan dan menyediakan prostitusi. Hasil penelitian ini untuk mengkaji bagaimana pertanggung jawaban pidana semua komponen yang terlibat tindak pidana prostitusi, faktor-faktor penyebab terjadinya prostitusi dan bagaimana upaya untuk meminimalisir tindak pidana prostitusi. Metode yang di gunakan untuk menganalisis dan mengkaji tindak pidana prostitusi yang di usahakan dan disediakan oleh hotel di Indramayu, penulis menggunakan metode yuridis-normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti data atau bahan perpustakaan yang merupakan data sekunder dan bahan hukum primer, bahan hukum sekunder maupun bahan hukum tersier serta mengkaji Dalam perspektif hukum pidana. Hasil penelitian ini disimpulkan bahwa dapat dimintakan pertanggung jawaban pidana semua komponen yang terlibat prostitusi seperti mucikari, pemilik hotel, WTS dan pengguna jasa WTS, faktor-faktor penyebab timbulnya prostitusi adalah: faktor ekonomi, faktor pendidikan, faktor yang menimbulkan prustasi (Broken Home,Putus Cinta dan Ditinggal Suami), faktor lingkungan (lingkungan sosial masyarakat), faktor kebutuhan biologis, dan faktor tipu daya. Faktor-faktor yang menyebabkan berkembangnya bisnis prostitusi adalah: kondisi kependudukan, perkembangan teknologi, faktor yuridis, kondisi lingkungan (kondisi lingkungan sosial dan kondisi lingkungan alam). Dan upaya yang dilakukan untuk meminimalisir tindak pidana prostitusi dengan upaya preventif seperti sosialisasi yang dilakukan oleh Dinas Sosial atau pengawasan yang dilakukan oleh Dinas Pariwisata dan upaya represif seperti razia yang dilakukan oleh Polisi dan Satpol PP . Kata Kunci: Tindak Pidana, Prostitusi, Disediakan Hotel. Prostitution is a phenomenon that has been around in the world since long, not exception to Indramayu. Even, prostitution has been penetrated the hotel business. The development in business providing rest areas (hotels) as prostitution place. In this case, the hotel makes business of and provides the prostitution. The findings of this research is to study the criminal accountability of all components involving in the crime of prostitution, the causing factors of the prostitution and the measures to minimize the prostitution. The method used to analyze and study the crime of prostitution made and provided by the hotel in Indramayu was juridical normative that is a research of law done by studying data or library materials as secondary data and primary, secondary, and tertiary legal materials and by studying it in the perspective of criminal law. The findings concluded that all the components involving in the prostitution can be liable such as the pimp, the hotel owner, the prostitutes, and the consumer of the prostitution. Causing factors of the prostitution are economic, education, factors triggering frustration (broken home, broken heart, and left by the husband), surroundings (social community), biological needs, and monkey business factors. And the measures taken to minimize the prostitution are through preventive measures such as socialization by Social Service or monitoring by Tourism Office and repressive measures such as a raid by the police and Satpol PP.
