Abstract
Reported by various media and institutions about 20-30 percent of the state budget funds allocated for the procurement of goods and services in government agencies can not be accounted ,both from the administrative aspects as well as its substance. Based on that, the identification of problem as follow : how is the procedure of goods and services procurement in accordance with statutory provisions? how the efforts of the police in handling cases of corruption procurement of medical equipment at the Health Office of Batam in accordance with the provisions legislation in force? The research used normative juridical approach that uses secondary data and primary data, ie data from the library and the field, in this case the reviewing Corruption procurement of medical equipment at the Health Department of Batam in connecting with Act No. 31 Year 1999 Jo Act No. 21 of 2001 on the eradication of corruption. Based on the results ,it can be concluded that the procurement procedures of government accordance with Presidential Decree number 70 year 2012 on the Second Amendment of regulation number 54 Year 2010 concerning Procurement of Government Goods / Services section 66 paragraph (7) ,Preparation of HPS is based on the data local market prices. Causes of corruption at the Health Office of Batam, namely Existence Self-Estimated Price (HPS) for the procurement of laboratory equipment medicine and environmental sanitation in Batam. The price is too high compared to the fair market value, because in preparing the HPS PPK just based on the data from the price quote distributor PT. Varia KharismaUtama without assessing the reasonableness price .The data price list has been engineered (mark-up) and it is contrary to Presidential Decree No. 70 of 2012 regarding the Second Amendment to Presidential Regulation No. 54 of 2010 on Procurement of Goods / Services , The efforts made by the police to prevent corruption in the Department of Health, by finding conspiracy between providers of goods with Commitment Officer. Keywords: Corruption, Procurement of Medical Equipment, Act No. 31 Year 1999 Jo Act No. 21 of 2001 on corruption Data yang dilansir oleh berbagai media dan institusi pemberantasan korupsi menunjukkan bahwa sekitar 20-30 persen dana APBN yang dialokasikan untuk pengadaan barang dan jasa di instansi pemerintah tidak dapat dipertanggungjawabkan, baik dari aspek administratif maupun aspek substansinya, hal tersebutlah yang membuat peneliti tertarik untuk meneliti tentang Bagaimana prosedur pengadaan barang dan jasa sesuai dengan ketentuan perundang-undangan yang berlaku? Apakah yang menjadi penyebab terjadinya Tindak Pidana Korupsi pengadaan alat kesehatan di Dinas Kesehatan Batam? Bagaimana upaya kepolisian dalam menangani kasus tindak pidana korupsi pengadaan alat kesehatan di Dinas Kesehatan Batam sesuai dengan ketentuan perundang-undangan yang berlaku? Dalam penelitian ini digunakan metode pendekatan yuridis normatif yang mempergunakan data sekunder dan data primer, yaitu data dari perpustakan dan lapangan, dalam hal ini mengkaji Tindak Pidana Korupsi pengadaan alat kesehatan di Dinas Kesehatan Batam di hubungkan dengan Undang-Undang No. 31 Tahun 1999 Jo Undang-Undang No. 21 Tahun 2001 tentang pemberantasan tindak pidana korupsi analisis data yuridis kualitatif. Berdasarkan hasil penelitian yang dilakukan dapat disimpulkan bahwa Prosedur pengadaan barang dan jasa pemerintah yaitu bahwa sesuai dengan Perpres 70 Tahun 2012 tentang Perubahan Kedua atas Perpres 54 Tahun 2010 tentang Pengadaan Barang/Jasa Pemerintah pasal 66 ayat (7) Penyusunan HPS didasarkan pada data harga pasar setempat. Penyebab terjadinya tindak pidana korupsi di Dinas Kesehatan Batam yaitu Adanya Harga Perkiraan Sendiri (HPS) atas pengadaan alatalat laboratorium kedokteran dan penyehatan lingkungan di satker Dinas Kesehatan Kota Batam TA 2013 yang disusun dan ditetapkan oleh tersangka terlalu tinggi dibandingkan dengan harga pasar yang wajar, karena dalam menyusun HPS PPK hanya berpedoman kepada data penawaran harga dari distributor PT. Cipta Varia Kharisma Utama tanpa melakukan penilaian kewajaran harga terlebih dahulu karena data daftar harga telah direkayasa (di mark-up) hal ini bertentangan dengan Peraturan Presiden RI Nomor 70 tahun 2012 tentang Perubahan Kedua atas Peraturan Presiden Nomor 54 tahun 2010 tentang Pengadaan Barang/Jasa Pemerintah. Upaya yang dilakukan oleh kepolisian agar tidak terjadi tindak pidana korupsi di Dinas Kesehatan yaitu salah satunya adalah, melakukan langkah-langkah dalam mencari dan membongkar dan membuktikan kalau pelelangan tersebut adanya persekongkolan yang tidak sehat antara penyedia barang dengan Pejabat Pembuat Komitmen.
