Abstract
Environmental damage caused by other than the nature can also be impacted by the construction of the settlement. The growing development in Jayamekar Village, Padalarang County extremely affected the stability of the surrounding environment. We need to keep in mind that the more increasing the development, the more severe the damage to the environment. This condition indicates the needs to control the environmental impact so that the risk of environmental damage can be minimized. CV. Go Sarana Guna as the house developer did not construct the water drainage as proper as it should be. Therefore, when it rained, the water from the settlement flew down to the settlement causing the flood and some damages. This research formulated the impact on the environmental damage from the construction of the house at Jayamekar Village, Padalarang County; the compliance by CV. Go Sarana to the environmental permit; and the legal settlement that can be taken by people of Jayamekar Village, Padalarang County who were impacted with the construction of the settlement. The method of research used was descriptive analytical method. Method of approach used was juridical normative. The stage of research used were library research and field research. Library research consisted of primary, secondary, and tertiary law materials. Data collecting technique were study of literatures and field study. Data analysis used was qualitative analysis. The research concluded that the impact of environmental damage due to the construction of settlement in Jayamekar Village was due to disfunction of water drainage so that when it rained, the rain water flew down to the community settlement causing flood and damage to the environment which was against the Article 69 (1) of Law Number 32, 2009 concerning the Environmental Protection and Management. CV. Go Sarana Guna had been comply to the law through the Impact Analysis and Environmental Monitoring and Environmental Management to get the environmental permit. Eventhough, in fact, CV. Go Sarana Guna violated the impact analysis they made. Legal settlement taken by the Jayamekar community was that the reported the impact and the damage they sufferred from to the Environmental Office of West Bandung Regency and filed for the compensation to CV.
