Abstract
Dewasa ini, Perlindungan atas Hak Kekayaan Intelektual (selanjutnya disingkat HKI) berawal dan berkembang dari adanya pemahaman atas perlunya suatu bentuk penghargaan khusus terhadap karya intelektual seseorang dan hak yang muncul dari karya itu. Menganggapi adanya permasalahan adanya situs yang memberikan akses unduh secara gratis terhadap film yaitu ganool, sedangkan di sisi lain film itu sendiri merupakan salah satu objek yang dilindungi oleh hak cipta. Dari hal tersebut, maka perlu dikaji mengenai bagaimanakah kualifikasi perbuatan penyebaran akses unduh film yang dilakukan oleh situs ganool, bagaimanakah pertanggungjawaban hukum pada situs ganool terhadap penyebaran akses unduh film, Bagaimanakah upaya hukum atas penyebaran akses unduh film yang dilakukan oleh situs ganool teresebut. Penelitian ini bersifat deskriptif-analitis, yaitu menggambarkan secara menyeluruh dan sistematis, tentang terjadinya penyebaran hak cipta film yang dilakukan oleh situs ganool. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis-normatif, yaitu metode yang bertujuan mencari asas, kaidah, dan norma dalam hukum positif. Tahap penelitian, meliputi penelitian kepustakaan yaitu penelitian terhadap data sekunder berupa bahan-bahan hukum yang terdiri dari tiga jenis yaitu bahan hukum primer berupa peraturan perundang-undangan, bahan hukum sekunder berupa buku-buku yang relevan serta hasil penelitian, dan bahan hukum tersier berupa penjelasan terhadap bahan hukum primer dan sekunder, penelitian lapangan yaitu penelitian langsung terhadap objek penelitian. Teknik pengumpulan data, meliputi studi dokumen yaitu suatu alat pengumpul data, yang digunakan melalui data tertulis, dan wawancara yaitu cara untuk memperoleh informasi dengan bertanya langsung kepada para pihak yang terlibat dalam permasalahan yang diteliti. Alat pengumpul data dalam penelitian kepustakan berupa catatan hasil inventarisasi bahan hukum dan alat pengumpul data dalam penelitian lapangan berupa daftar pertanyaan, handphone recorder dan flashdisk. Analisis data menggunakan metode yuridis-kualitatif, yaitu menganalisis data sekunder dan data primer yang dianalisis tanpa rumus statistik. Berdasarkan hasil penelitian, bahwa terjadinya kualifikasi unduh film tersebut disebabkan Film atau Sinematografi yang dikenal di dalam UUHC merupakan salah satu objek yang dilindungi oleh hak cipta sesuai dengan yang diatur dalam Pasal 12 huruf k. Pertanggungjawaban atas penyebaran film yaitu perbuatan tersebut merupakan perbuatan pelanggaran terhadap hak cipta dan hak terkait. Pasal 72 ayat (1) UUHC. Upaya hukum terhadap ganool tersebut mendaftarkan karya cipta dan pemahaman pencipta terhadap Undang – undang Hak Cipta. Data collection techniques, including studies document that a data collection tool, which is used by the data writing, and interview is a way to obtain the information by asking questions directly to the parties involved in the problems studied. Data collection tool in the study kepustakan form of legal material inventory records and means of collecting data in the field of research in the form of a list of questions, the phone recorder and flash. Juridical analysis of data using qualitative methods, namely analyzing secondary data and primary data which are analyzed without statistical formulas.
