Abstract

Skripsi ini berjudul “Tinjauan yuridis kriminologis tindak pidana pemalsuan kartu kredit di hubungkan dengan undang-undang nomor 11 tahun 2008 tentang informasi dan transaksi elektronik”. Perlindungan terhadap para pengguna kartu kredit merupakan suatu yang mutlak untuk dilakukan, hal ini timbul seiring dengan kemajuan zaman terutama menyangkut penggunaan masyarakat luas terhadap layanan kartu kredit. Dalam penggunaan kartu kredit masyarakat pemilik kartu kredit seringkali dirugikan baik dalam kaitannya dengan hubungan hukum perdata maupun hukum pidana (perbuatan para pelaku kejahatan Pemalsuan kartu kredit). Berdasarkan permasalahan tersebut, peneliti telah mengidentifikasi masalah sebagai berikut: Faktor apa yang menyebabkan terjadinya pemalsuan kartu kredit? Bagaimana Undang-Undang No. 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik dapat menjangkau tindak pidana pemalsuan kartu kredit? Upaya apa yang dapat dilakukan untuk menanggulangi kejahatan kartu kredit. Metode penelitian yang dipergunakan dalam penelitian hukum ini adalah spesifikasi penelitian bersifat deskriptif analitis dan menggunakan metode pendekatan yuridis normatif yaitu suatu metode pendekatan yang melihat permasalahan yang diteliti dengan menitikberatkan pada data sekunder sebagai bahan penelitian pokok dan data primer sebagai penunjang. Kemudian teknik pengumpulan data dilaksanakan melalui studi kepustakaan dan lapangan. Metode analisis yang dipergunakan adalah yuridis kualitatif yang bertitik tolak dari teori, konsep maupun peraturan perundang-undangan yang ada sebagai norma hukum positif untuk kemudian dianalisis secara kualitatif, tanpa menggunakan rumus dan angka. Adapun kesimpulan penelitian ini, yaitu Ketentuan hukum pidana yang mengatur tentang kejahatan pemalsuan kartu kredit, diantaranya terdapat dalam KUHP, di luar KUHP, dan dalam Undang-Undang (Informasi dan Transaksi Elektronik. Tinjauan kebijakan hukum pidana indonesia dapat menjangkau tindak pidana pemalsuan kartu kredit, tindak pidana pemalsuan kartu kredit yang di hubungkan dengan undang-undang nomor 11 tahun 2008 tentang informasi dan transaksi elektronik. Berbagai macam modus-modus kejahatan kartu kredit yang dilakukan oleh para carder (pelaku kejahatan kartu kredit) yang terdapat dalam masyarakat sehingga membawa kerugian bagi para pengguna dan pemilik kartu kredit. Selain itu juga modus operandi kejahatan kartu kredit yang dilakukan oleh carder selalu bergeser dari waktu ke waktu seiring perkembangan teknologi dan informasi. Penanggulangan pemalsuan kartu kredit dapat dilakuan dengan 2 (dua) cara, yaitu sarana penal (hukum pidana) dan sarana non-penal (diluar hukum pidana) penanggulangan secara preventif dan penanggulangan secara Represif. Kata Kunci : Transaksi Elektronik, Pemalsuan, Kartu Kredit. ABSTRACT This thesis entitled "Overview of juridical criminological credit card fraud a criminal offense in connecting with the law number 11 of 2008 on information and electronic transactions". The protection of credit card users is an absolute must to be done, it is raised in line with the progress of time, especially regarding the use of the general public against credit card services. In the use of public credit cards credit card owners are often disadvantaged both in relation to the legal relationship of civil and criminal law (the actions of the perpetrators Counterfeit credit cards). Based on these problems, researchers have identified the problem as follows: What factors led to the occurrence of credit card fraud? How to Act No. 11 Year 2008 on Information and Electronic Transactions can reach the crime of credit card fraud? Efforts to what can be done to combat credit card fraud. The research method used in legal research is descriptive analytical research specifications and using normative juridical approach is an approach that saw the problems studied by focusing on secondary data as basic materials research and primary data as a supporter. Then the data collection techniques implemented through library research and field. The analytical method used is a qualitative juridical starting point of theories, concepts and regulations that exist as a norm of positive law to then analyzed qualitatively, without using formulas and numbers. The conclusions of this study, namely the provision of criminal law that regulates the crime of counterfeiting credit cards, of which there are in the Criminal Code, outside the Criminal Code, and the Law (Information and Electronic Transactions. Overview of criminal law policy Indonesia can reach the crime of credit card fraud, the crime of credit card fraud which connect with the law number 11 of 2008 on information and electronic transactions. Various modes of credit card crime committed by the carder (perpetrators of credit cards) are available in the community that bring harm to the the user and the owner of the credit card. it is also the modus operandi of credit card crime committed by carder always shifted over time as the development of technology and information. Combating counterfeiting credit cards can been made by two (2) ways, namely penal (criminal law) and non-penal facilities (outside the criminal law) the reduction of preventive and repressive handling it.
