Abstract

ASN ( Aparatur Sipil Negara ) merupakan tulang punggung negara dalam mengelola profesional, jujur distributif dan layanan berkualitas sesuai dengan tugas mereka, fungsi dan kewenangan. Undang-undang Nomor 5/2014 tentang ASN menunjukan bahwa ada penempatan untuk ASN di Pengadilan Negeri Bale Bandung. Masalah hukum mengenai penempatan ASN terkait dengan posisi dan fungsi ASN, masalah yang dialami oleh ASN dalam menjalankan tugas dan fungsinya sesuai dengan hukum dan solusi untuk hal itu. Penulisan skripsi ini bersifat deskriptif analisi dengan menggunakan metode pendekatan yuridis normatif yaitu pendekatan atau penelitian hukum yang menggunakan sumber-sumber data primer, sekunder dan tersier seperti peraturan perundang-undangan, sejarah hukum, perbandingan hukum, teori-teori hukum dan pendapat-pendapat sarjana hukum yang berhubungan. Selanjutnya dianalisis dengan metode yuridis kualitatif dalam arti bahwa data yang di peroleh dianalisis secara kualitatif dengan tidak menggunakan rumus atau data statistik melainkan hanya berupa uraian-uraian yang berisi mengenai adanya kepastian hukum Berdasarkan penelitian dapat disimpulkan bahwa posisi ASN di Pengadilan Negeri Bale Bandung, berdasarkan Undang-undang no. 5 Tahun 2014 Tentang Aparatur Sipil Negara, sudah sesuai dengan hukum. Namun masih belum ada regulasi teknis seperti peraturan pemerintah, ini akan mempengaruhi keberadaan ASN di Pengadilan distrik Bale Bandung mengenai struktur dan birokrasi/ organisasi. Ada dua sub variabel yang menyebabkan dampak yang signifikan terhadap birokrasi ASN, mereka adalah prosedur operasi standar dan fragmentasi, sop adalah respons dari pelaksana untuk menjawab permintaan atas tugas karena kurang dalam waktu dan sumber daya dan bersedia untuk keseragaman dalam organisasi yang kompleks. Kita bisa melihat SOP dalam organisasi pelayanan publik agar efektif, sehingga peraturan hukum yang ketat di perlukan dalam bentuk peraturan pemerintah. Kata Kunci : Pengadilan Bale Bandung, ASN, Pelayanan Publik The ASN (National State Apparatus) is the backbone of a state in managing a professional, honest, distributive and qualified service in accordance to their duty, function and authority. The Law No.5/2014 on ASN indicates that there is a placement for ASN in the Bale Bandung District Court. Legal issue concerning the ASN placement, related to the position and function of ASN, problems experienced by ASN in performing their duties and functions in accordance to the Law and solutions for that matter. This paper is written in descriptive analytical style using the juridical normative method of approach, it is a legal study through exploration of primary, secondary, and tertiary sources of data such as legislations, legal history, legal comparative, theories, and opinions of related law scholars. The analysis was juridical qualitative, means that the data were analyzed qualitatively without any statistical formulation, instead it is filled with description regarding to the matter of legal certainty. The research concluded that the position of ASN in Bale Bandung District Court, based on the Law No.5/2014 on National State Apparatus, has been in accordance to the law. However there is still no technical regulation such as Government Regulation, this will affect the existence of ASN in Bale Bandung District Court regarding to their structure and bureaucracy /organization. There are two sub-variables that cause significant impact on ASN bureaucracy; those are the Standard Operating Procedures and the fragmentation. The SOP is a respond of implementer to answer the demand over duty because of lacking in time and resources and the willing for uniformity in a complex organization. We can see the SOP in public services organizations. In order to be effective, thus a strict legal regulation is necessary in a form of Government Regulation.
