Abstract

Birokrasi perizinan yang berbelit-belit merupakan salah satu permasalahan yang menjadi penghambat bagi perkembangan dunia perekonimian, terlebih lagi dalam dunia usaha di Indonesia. Masyarakat dan para pelaku usaha sering mengeluhkan masalah proses pelayanan perizinan yang memerlukan waktu lama, banyaknya instansi yang mengeluarkan izin serta banyaknya pungutan yang harus dibayar oleh pemohon izin. Melihat kondisi tersebut, pemerintah mengeluarkan beberapa kebijakan untuk terciptanya deregulasi dan debirokratisasi dalam penyelenggaraan pelayanan perizinan. Kondisi ini mengakibatkan peraturan perundang-undangan yang mengatur tentang kebijakan perizinan menjadi tumpang tindih, terlebih lagi antara peraturan yang satu dengan yang lainnya tidak mencerminkan tertib peraturan perundang-undangan. Sejalan dengan uraian di atas, maka penulis merumuskan permasalahan sebagai berikut: Bagaimanakah implementasi Permendagri No 20 Tahun 2008 tentang Pedoman Organisasi dan Tata Kerja Unit Pelayanan Terpadu di Daerah dalam kebijakan pelayanan perizinan di Kota Bandung? Apakah mekanisme pelayanan perizinan terpadu satu pintu telah memenuhi asas-asas umum pemerintahan yang layak? Bagaimanakah upaya pemerintah Kota Bandung dalam menentukan langkah harmonisasi hukum dalam pengaturan tugas dan fungsi lembaga dalam penyelenggaraan pelayanan perizinan terpadu satu pintu? Penelitian ini bersifat deskriftif analistis, dengan maksud untuk memperloh gambaran mengenai kebijakan sistem perizinan satu pintu ditinjau dari sudut AAUPL. Sebagai penelitian normatif, data diperoleh melalui penelusuran dokumendokumen hukum, baik yang berupa dokumen hukum primer, sekunder, maupun tersier. Metode yang digunakan dalam menganalisis hasil penelitian dilakukan melalui cara yuridis kualitatif berupa uraian pertanyaan baik dilihat dari isi/substansi maupun formal/prosedur dengan menggunakan cara-cara yang lazim digunakan dalam ilmu hukum seperti penafsiran dan konstruksi hukum, serta selalu mengaitkannya dengan norma, asas, kaidah atau lembaga hukum yang mengaturnya Hasil penelitian, untuk mengantisipasi ketidakjelasan mengenai lembaga mana, bentuk lembaga seperti apa, mekanisme pertanggungjawaban serta adanya suatu jaminan dan kepastian hukum dalam penyelenggaraan pelayanan publik di daerah, maka sudah selayaknya pemerintahan daerah mengajukan pengujian yuridis atau langkah hukum lainnya terhadap peraturan perundang-undangan yang mengatur tentang kebijakan pelayanan perizinan terlebih lagi terhadap Permendagri No 20 Tahun 2008, dan pelaksanaan perizinan dikembalikan kepada perangkat daerah yang memiliki kewenangan operasional dalam fungsi teknis dan administrasi yang dalam hal ini dinas tertentu, dengan sistem pelayanan perizinan satu atap. Kata Kunci: Organisasi, Pemerintah, Pelayanan Terpadu v ABSTRACK The complexity of bureaucracy in processing of licences is a key impediment to the world’s economic growth, especially in Indonesia. The public and businessmen mostly complain about the lengthy process, the number of offices/departments involved, and the cost to obtain any kind of licenses from government. In view of this situation, the government has already issued several policies to create deregulation and debureaucratic reform in the licensing service. These policies unfortunately are redundant, and do not seem to properly follow the guidelines for establishing government regulation. Is line with the above description, the authors formulate problem as follows : Implementation of Regulation Interior Minister No 20 Year 2008 on organization guidline and administration of integrated licensing unit service in local government, in the policy of licensing service in the city of Bandung? The service mechanism integrated one-stop licensing service has met the general principles of proper administration? How Bandung city government’s efforls in determining the legal harmonization step in setting the duties and functions of agencies in the implementation of integrated one-stop licensing service? The approach of this research is descriptive analytical, to provide a view on intregated licensing services through one stop services from the general principles of good administration perspective. As a normative research, data is obtained through readings of legal document, in the form of primary, secondary as well as tertiary legal documents. The method used in analyzing results of research conducted by means of qualitative juridical form of description of the question whether viewed from the contents or substance and formal or procedures using methods that are commonly used in the science of law interpretation and construction law, as well always relate it to the norms, principles, rules, or laws that govern institutions. Research result, to anticipate the unclear guidance on issues such as : which institution is responsible, what is the mechanism of responsibility, and availabity of legal assurance of public services in regional governments, it is necessary for regional governments to reform its policies and regulations on the licensing as specified in Minister of Home Affair’s Regulation (Permendagri) No. 20 Year 2008, and to push the decision functions back to the local level that has the technical and administrative authority, using the integrated one roof service system.
