Abstract

Pelaksanaan pembebasan tanah, baik yang menyangkut pengadaan tanah bagi kepentingan pembangunan untuk kepentingan umum, maupun pembebasan tanah untuk kepentingan swasta selalu menimbulkan masalah, khususnya hal ganti rugi, karena ketidaksiapan aparat. Penelitian ini mempertanyakan bentuk pelaksanaan ganti rugi atas kepemilikan tanah untuk kepentingan pembangunan menurut Peraturan Presiden Republik Indonesia Nomor 99 Tahun 2014 Tentang Penyelenggaraan Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Mekanisme ganti rugi atas tanah dalam pembangunan Jalan Tol Cikampek-Palimanan dan Masalah yang timbul dalam pelaksanaan ganti rugi atas tanah pembangunan Jalan Tol Cikampek-Palimanan dan Bagaimana cara menyelesaikannya. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan sejarah hukum, sosiologi hukum, politik hukum, dan filsafat hukum.Data yang digunakan adalah data sekunder berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Analisis data kualitatif dalam penelitian ini berupa deksripsi hukum positif dan sistematisasi hukum positif. Hasil penelitian ini bahwa, Pelaksanaan Bentuk Ganti Rugi Menurut Peraturan Presiden Republik Indonesia Nomor 99 Tahun 2014 Tentang Penyelenggaraan Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Dalam Pasal 1 angka 2 bahwa Ganti Kerugian penggantian yang layak dan adil kepada pihak yang berhak dalam proses pengadaan tanah. Nilai Ganti Kerugian dilakukan bidang per bidang tanah, meliputi: tanah, ruang atas tanah dan bawah tanah, bangunan, tanaman, benda yang berkaitan dengan tanah, dan kerugian lain yang dapat dinilai dalam bentuk: uang, tanah pengganti, permukiman kembali, kepemilikan saham dan bentuk lain yang disetujui oleh kedua belah pihak. Mekanisme besaran ganti rugi pihak yang berhak dapat mengajukan keberatan kepada Pengadilan Negeri setempat dalam waktu paling lama 14 hari kerja setelah ditandatangani berita acara hasil musyawarah. Masalah yang timbul dalam pelaksanaan ganti rugi atas tanah pembangunan Jalan Tol Cikampek-Palimanan, masyarakat di sekitar yang terkena pembangunan Jalan Tol berpendapat bahwa proses pembebasan tanah berjalan dengan alot, harga ganti kerugian masih jauh dengan harapan warga dimana sedang dilakukan proses konsinyasi (penitipan ganti kerugian lewat Pengadilan Negeri). Kata Kunci: Ganti Rugi, Pengadaan Tanah. The Land Procurement, either related to the development and public interest or for private matter, always cause problems, especially concerning the compensation because of the ill-prepared apparatus. This research questioned about the compensation upon land ownership for development cause with regard to President Decree No.99/2014 on the Land Procurement for the Development of Public Interest, the mechanism of compensation for the construction of CikampekPalimanan Highway, its problems along with the solution. This research applied the juridical normative method with the approach of legal history, sociology of law, legal policy, and philosophy of law. The data was secondary data such as primary, secondary, and tertiary legal sources. Data analysis was qualitative and this was a descriptive research of positive law and its systematization. The research concluded that the compensation, according to the President Decree No.99/2014 on the Land Procurement for the Development of Public Interest, is a just and fair restitution of damage for the right party during the process of land procurement. The amount of compensation is counted by every lot, this included: the upper terrain, upper terrain space, under terrain, buildings, plants, other matter related to the terrain, and other loss that can be valued in money, substitute lot, rehabilitation, stock ownership, or other form which are agreed by all parties. The mechanism for number of compensation can be challenged by submitting objection to the local Court, in 14 days period at length after the signature of minute of mediation. The problems for the compensation of construction of Cikampek-Palimanan Highway are that the people felt the land procurement was hard and the value of compensation still far way beyond what were expected, while at the same time consignation is still in process (the caretaking of compensation by the Court).
