Abstract

In Indonesian law, eigendom is a form of land ownership originated from western tradition, despite it was issued during Dutch colonial period for Indonesian citizens. According to the Law No. 5/1960, eigendom shall be converted into one type of land ownership. However, there are still many land attached to eigendom status. The question is about legal protection for the landowners based on certificate of ownership against eigendom verponding related to the law No. 5/1960 on the principles of land regulation, and dispute settlement for these cases. The method was descriptive analytical specification and the approach was juridical normative. Research stage utilized literature research and field research. Data was collected through document study and interviews. Data analysis was juridical qualitative. The research found that, eigendom status for land ownership was concluded in 24 September 1980, any owner of such land must register the formerly converted land to the Land Registration Office in order to avoid the land status altered into State Land. Legal protection for land ownership cannot be separated from idea of justice during law enforcement. Based on Article 19 of the Law No. 5/1960 on the Basic Principles for Land, land registration is mandatory and shall be in instance to provide legal protection and undeniable proof of evidence. Settlement for conflict on land still has no concrete arrangements. Legal basis to resolve the land dispute is Article 35 of the Ministry of Interior Decree No. 72/1981 on the Organization and Duty of Provincial Land Directory and District Land Agency. The dispute settlement can be concluded by mediation or litigation process. Keywords : Protection, Deed of Ownership, Eigendom Verponding.
