Abstract
Traffic accidents are unexpected and accidental involving vehicles resulting human casualties and / or property losses. The problem in traffic accidents involves not only adults as perpetrators of traffic accidents in various cases of traffic accidents also perpetrated by child offenders who cause minor injuries, serious injuries, and even deaths. The settlement of cases involving children in traffic accidents is also different. The settlement of the case uses a restorative justice approach. Based on the description, then the legal issue studied is the application of restorative justice in traffic accidents conducted by children connected with Law Number 11 Year 2012 About Child Criminal Justice System. The research method used in the writing of this thesis is a descriptive analytical research specification that describes the facts in the form of data, research methods used in this study is the normative juridical approach method, which to examine the norms in positive law, the research phase using literature study and field research, data collection tools with literature studies and interviews. Data analysis is done by qualitative juridical method that is research result will be analyzed. The results of this research study show that: first the process of diversion in solving traffic accidents cases conducted by children in the level of investigation. The second application of the concept of restorative justice in the case of traffic accidents conducted by children. The third effort to guarantee the rights of victims of traffic accidents with the application of the concept of restorative justice. Keywords: Traffic Accidents, Restorative Justice, Investigators.
