Abstract
In the event of selling of Meikarta Apartment by Lippo Group is causing violation on fault basis (negligence or intention) as it is regulated under Article 1365 of the Civil Code and about negligence or intentional violations as it is regulated in Artcile 1366 of the Civil Code, the consequence for the action is the contract is declared ad void because of the elements of agreement, based on Article 1320 Civil Code, is missing. It is the objective condition of an agreement which is missing in this case, because the development of apartment has not reach 20% completion and some buyer has already paid 100% of the cost. The law stated that developer should not take 100% payment from the buyer when the building still under 20% of completion. The dispute can be settled through congregation as initial process or negotiation, mediation and arbitration. They also can take litigation process as final solution.
