Abstract

Skripsi ini dilatar belakangi oleh penerbitan Izin Mendirikan Bangunan (IMB) tanpa disertai dokumen lingkungan seperti amdal, ukl/upl, izin lingkugan oleh Pemerintahan Kabupaten Bandung berdasarkan Putusan Pengadilan Tata Usaha Negara Bandung Nomor 29/G/2014/PTUN-BDG, artinya Pemerintahan Kabupaten Bandung tidak mengikuti prinsip-prinsip Good Governance dalam menyelenggarakan tertib administrasi. Atas dasar tersebut muncul beberapa pertanyaan antara lain : Bagaimana penerapan Prinsip Good Governance dalam penerbitan Izin Mendirikan Bangunan (IMB) di lingkungan Pemerintahan Kabupaten Bandung?, Bagaimana kendala yang dihadapi Pemerintahan Kabupaten Bandung dalam menerapkan Prinsip Good Governance dalam penerbitan Izin Mendirikan Bangunan (IMB)?, Bagaimanakah upaya yang dapat dilakukan Pemerintahan Kabupaten Bandung untuk mengoptimalkan penerapan Prinsip Good Governance dalam penerbitan Izin Mendirikan Bangunan (IMB)? Metode dalam skripsi menggunakan Spesifikasi Penelitian deskriptif analistis, yaitu merumuskan peraturan-peraturan yang berlaku dikaitkan dengan teori yang menyangkut permasalahan yang diteliti, metode pendekatan Yuridis Normatif, yaitu dengan pengumpulan data-data yang dilakukan melalui penelaahan dengan studike pustakaan dan didukung oleh data lapangan dari hasil wawancara. Tahap Penelitian diawali dengan Penelitian Lapangan dan Penelitian kepustakaan, dan dilanjutkan dengan Pengumpulan Data melalui Studi Kepustakaan dan Studi Lapangan, data yang sudah diperoleh selanjutnya dianalisis secara yuridis kualitatif yaitu dengan penguraian deskriptif analitis guna memberkan gambaran mengenai penerbitan Izin Mendirikan Bangunan (IMB) dilingkungan Pemerintahan Kabupaten Bandung berdasarkan Prinsip Good Governance. Kesimpulan dalam skripsi ini menunjukan bahwa, pertama ; Penerapan Prinsip Good Governance dalam Penerbitan Izin Mendirikan Bangunan (IMB) di Lingkungan Pemerintahan Kabupaten Bandung belum optimal dikarenakan adanya beberapa Prinsip-prinsip Good Governance yang tidak diikuti atau dilaksanakan seperti Prinsip Aturan Hukum dan Prinsip Akuntabilitas, kedua ; Kendala yang Dihadapi Pemerintahan Kabupaten Bandung Dalam Menerapkan Prinsip Good Governance dalam Penerbitan Izin Mendirikan Bangunan (IMB) antara lain pihak pemohon tidak memenuhi persyaratan khusus dan persyaratan teknis, ketiga ; Upaya yang dapat dilakukan Pemerintahan Kabupaten Bandung untu kmengoptimalkan penerapan prinsip Good Governance dalam penerbitan Izin Mendirikan Bangunan (IMB) antara lain melakukan advokasi terhadap masyarakat atau pemohon yang akan membuat Izin Mendirikan Bangunan (IMB) agar adanya sinergis antara pemohon dan pemerintah untuk bersama Mengoptimalkan Penerapan Prinsip Good Governance dilingkungan Pemerintahan Kabupaten Bandung. Kata kunci :Pemerintahan Kabupaten Bandung, Good Governance, Izin Mendirikan Bangunan (IMB). This thesis is motivated by the issuance of Building Permit (IMB) without accompanying documents such as the environment amdal, ukl/ukp, Government environmental permit by the Bandung District Court decision by Bandung State Administrative nomor 29/G/2014/PTUN-BDG, Bandung regency government means not follow the principles of Good Governance in organizing the orderly administration. On this basis there were several questions, among others : How the application of Principles of Good Governance in the issuance of building permit (IMB) in the County Government Bandung?, How the constraints faced by Bandung District Government in implementing the Principles of Good Governance in the issuance of Building Permit (IMB)?, How do government efforts Bandung District to optimize the application of Principles of Good Governance in the issuance of Building Permit (IMB)? Method in the thesis uses descriptive analytical research Specifications, is to formulate regulations that apply to the theory concerning problems studied, Normative juridical approach, ie the collection of data is done through research with studike library and supported by field data from the interviews. Stage study begins with field research and research literature, and continued with data collection through literature study and Field Studies, data obtained was then analyzed by juridical qualitative descriptive analytical decomposition to memberkan overview of the issuance of Building Permit (IMB) within the County Government Bandung based Principles of Good Governance. The conclusion of this paper shows that, first : Applying the Principle of Good Governance in the Issuance of Building Permit (IMB) in Bandung regency government environment is not optimal due to some principles of good governance are not followed or implemented such as the principle of the Rule of Law and Accountability Principles, two : Obstacles Faced by Bandung District Government In Applying the Principles of Good Governance in the Issuance of Building Permit (IMB), among others, the applicant does not meet the specific requirements and technical requirements, three : Efforts to do Bandung regency government to optimize the application of the principles of good governance in the issuance of Building Permit (IMB) among others, to advocate against the community or the applicant will make a Building Permit (IMB) so that the synergy between the applicant and the government to jointly Optimizing Application of Good Governance environment Bandung regency administration.
