Abstract
Pemerintah daerah Kota Bandung telah mengeluarkan kebijakan yang dituangkan dalam Peraturan Daerah khusus di Kota Bandung diatur dalam Peraturan Daerah No.7 Tahun 2012 Tentang Penyelenggaraan Kepariwisataan. Salah satu yang diatur dalam Perda tersebut terkait dengan pemberlakuan jam operasional hiburan malam. Pada Pasal 27 ayat 7, 8 dan 9 Peraturan Daerah No. 7 Tahun 2012. Pengaturan pada pasal tersebut menyiratkan bahwa hiburan malam di Kota Bandung harus tutup pukul 03.00. Dengan adanya pernyataan pada pasal tersebut menunjukkan bahwa Pemerintah Kota Bandung telah mengatur jam operasional hiburan malam untuk mewujudkan ketertiban dan keamanan Adapun permasalahan yang dibahas dalam skripsi inia adalah: Bagaimana implementasi dari Perda No. 7 Tahun 2012 tentang penyelenggaraan kepariwisataan Kota Bandung yang berhubungan dengan jam operasional hiburan malam dibandung? Upaya apa yang sebaiknya dilakukan dalam penegakan Peraturan Daerah No. 7 Tahun 2012 Tentang Penyelenggaraan Kepariwisataan? Hambatan-hambatan apa yang ada dalam pelaksanaan pembatasan am operasional hiburan malam di Kota Bandung?. Metode penelitian yang digunakan dalam penelitian ini adalah spesifikasi penelitian deskriptif analitis, yaitu suatu metode yang bertujuan untuk memperoleh gambaran secara menyeluruh dan sistematis terhadap peraturan-peraturan yang berlaku dan dikaitkan dengan teori hukum dan pelaksanaannya, sedangkan metode pendekatan yang digunakan adalah yuridis normatif yaitu metode yang menggunakan sumber-sumber data sekunder, yaitu peraturan perundang-undangan, teori-teori hukum, dan pendapat para ahli, yang kemudian dianalisis dengan metode analitis data yuridis kualitatif serta menarik kesimpulan dari masalah yang digunakan untuk menguji dan mengkaji data sekunder tersebut. Hendaknya perlu dilakukan sosialisasi secara komprehensif bagi para pelaku usaha hiburan malam dan para Satpol PP yang ditugaskan untuk menegakan Peraturan Daerah Kota Bandung No. 7 Tahun 2012 Tentang Penyelenggaraan Kepariwisataan dalam hal pembatasan jam operasional hiburan malam tepat dan adil, disamping memperhatikan keadilan secara prosedural sesuai hukum acaranya. Perlu bagi Polri untuk memberikan himbauan secara optimal dan berkesinambungan mengenai penerapan Perda ini. Hendaknya dalam melaksanakan tugas dan wewenangnya tersebut pihak pemerintah Kota Bandung harus senantiasa melihat kepentingan masyarakat. Sumber Daya harus memadai meliputi sumber daya aparatur dalam proses pelaksanaan Kebijakan Peraturan Daerah Kota Bandung No. 7 Tahun 2012 tentang Penyelenggaraan Kepariwisataan dalam hal pembatasan jam operasional hiburan malam. Kata Kunci : Perda, Pembatasan, Hiburan. Bandung government has issued a policy as outlined in the Special Local Regulation No 7 year 2012 on the Implementation of Tourism. One set out in the regulation relating to the implementation of the operational hours night entertainment in Article 27, paragraph 7, 8 and 9 . The setting on the article implies that the night in Bandung must close at 03.00 a.m. it indicates that the Bandung City Government has set the operating hours with the purpose to create an order and securit.y The issues discussed in this paper are: How is the implementation of Regulation No. 7 of 2012 on the operation of tourism-related Bandung operating hour for night entertainment? What efforts should be made in the enforcement of Regional Regulation No. 7 of 2012 on the Implementation of Tourism? Barriers what is in the implementation of operational restriction am nightspots in the city of Bandung ?. The method used in this research is the specification of descriptive analytical research, which is a method that aims to obtain a thorough and systematic against the regulations in force and associated with legal theory and practice, whereas the approach used is normative juridical method that using secondary data sources, namely legislation, legal theories, and the opinion of experts, which was then analyzed by qualitative analytical method juridical data and draw conclusions on the issue are used to test and assess the secondary data. Socialization should be done in a comprehensive manner by the those nightclubs and the municipal police assigned to enforce the Bandung Regional Regulation No. 7 of 2012 on the Implementation of Tourism in terms of restrictions on operating hours of the night entertainment and fairness, besides the procedural justice in accordance with the procedural law. Need for the police to provide optimal and sustainable appeal regarding the application of this Regulation. Resources should include adequate personnel in the process of policy implementation of this regulation. Keywords: Regulation, Restricted, Entertainment.
