Abstract

Pengupahan merupakan sisi yang paling rawan di dalam hubungan industrial. Di satu sisi upah adalah merupakan hak bagi pekerja/ buruh sebagai imbalan atas jasa dan/ atau tenaga yang diberikan, di lain pihak pengusaha melihat upah sebagai biaya. Dalam rangka memberikan perlindungan terhadap pekerja/ buruh atas jumlah penghasilan yang diperolehnya, maka ditetapkan Upah Minimum oleh Pemerintah. Dari hal tersebut, maka perlu dikaji mengenai pelaksanaan Upah Minimum dalam mensejahterakan pekerja/buruh, dampak terhadap perusahaan kecil dengan adanya Upah Minimum, dan tindakan yang dilakukan Dinas Tenaga Kerja jika ada perusahaan yang tidak membayar pekerjanya sesuai dengan Upah Minimum. Penelitian ini bersifat deskriptif-analitis, yaitu menggambarkan secara menyeluruh permasalahan berdasarkan data yang diperoleh. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis-normatif, yaitu mengkaji penerapaan kaidah atau norma dalam hukum positif. Tahap penelitian, meliputi penelitian kepustakaan dengan jalan meneliti dan menginventarisasi data sekunder berupa bahan-bahan hukum yang terdiri dari tiga jenis yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, penelitian lapangan yaitu penelitian langsung terhadap objek penelitian. Teknik pengumpulan data, meliputi studi dokumen yaitu suatu alat pengumpul data yang digunakan melalui data tertulis, dan wawancara yang dilakukan dengan bertanya langsung kepada para pihak yang terlibat dalam permasalahan yang diteliti. Alat pengumpul data dalam penelitian kepustakaan berupa suatu pembahasan buku-buku referensi atau peraturan perundang-undangan dan alat pengumpul data dalam penelitian lapangan berupa daftar pertanyaan dan tape recorder. Analisis data menggunakan metode yuridis-kualitatif, yaitu dengan menganalisis dan mengkualifikasi data sekunder dan primer tanpa rumus statistik. Berdasarkan hasil penelitian, bahwa Upah Minimum yang ditetapkan pemerintah belum mampu menjamin kesejahteraan pekerja/buruh khususnya di PT. Iwamatex dan Perusahaan Kerupuk Walet. Dampak terhadap perkembangan perusahaan kecil dengan adanya penetapan Upah Minimum berpengaruh kepada tingkat produktivitas perusahaan. Dinas Tenaga Kerja Kabupaten Bandung tidak mampu berbuat banyak terhadap permasalahan pengupahan diantara Pengusaha dengan pekeja/buruh karena keduanya sama-sama mempunyai kepentingan. Remuneration is the most vulnerable aspect in industrial relations. On one side,it is the right the workers in exchange for services and / or energy supplied, on the other hand, employers seeing it as expenses. In order to provide protection to workers on the amount of earned income, the minimum wage set by the Government. From this, it is necessary to study on the implementation of the Minimum Wages in the welfare of workers / laborers, the impact on small enterprises with the minimum wage, and the action taken Department of manpower if there are companies that do not pay workers according to the minimum wage. This research is descriptive-analytical, that illustrates the overall problem based on the data obtained. The method used in this study is juridical- normative, the implementation of reviewing rules or norms in the positive law. Research phase, covering research and literature by examining the inventory of secondary data in the form of legal materials which consist of three types ofprimary legal materials, secondary law, and tertiary legal materials, field research is the research directly to the object of research. Data collection techniques, including studies document that a data collection tool used through the written data, and interviews conducted by asking directly to the parties involved in the problems studied. Data collection tool in the study of literature in the form of a discussion of reference books or legislation and means of collecting data in the field of research in the form of a list of questions and a tape recorder. Juridical analysis of data using qualitative methods, by analyzing and qualifying secondary andprimary data without statistical formulas. Based on the results of the research, that the minimum wage set by the government is not able to guarantee the welfare of the workers / laborers, especially in PT. Iwamatex and Crackers Company Swallow. Impact on the development of small companies with the stipulation of minimum wage affects the productivity of the company. Department of Manpower Bandung regency unable to do much against the problems of remuneration among Employers with wokers laborers because they both have an interest.
